If an employee has an accident and their BHP training is overdue, the employer bears full civil liability (Art. 415, 444-445 of the Civil Code). This means potential compensation for health loss, treatment costs, and damages. ZUS (Social Insurance Institution) may also file a recourse claim against the employer.
According to Art. 207 §1 of the Labour Code, the employer is responsible for the state of health and safety at the workplace. This liability cannot be transferred to other persons — not even to the BHP service, managers, or external companies.
